Can I put a solar array on the roof without a permit?
Yes — but the array is not "permit-free". Solar and photovoltaic systems are notifiable in Liechtenstein (Art. 73 lit. h Building Act, BauG, LR 701.0): before installation you must notify the building authority, with detail plans of the system (BauV). In building-law terms the mounting counts as a minor change that must be released in writing after the municipality has been heard (BauV Art. 61 to Art. 82 para. 3 BauG). The myth: "Since the energy transition, solar needs no permit." That is the Swiss rule (RPG Art. 18a: exempt in building zones). In Liechtenstein the notification duty remains, and in protection, core and townscape zones or for cultural assets it turns into a full building permit. On top of that the Regulation on the Design of Solar Systems (2024) applies.
📋 The rules
- Notification duty (Art. 73 lit. h BauG): the installation of solar and photovoltaic systems is expressly notifiable. That is a formal procedure with documents — not simply getting started, as many know it from neighbouring countries.
- Minor change with a municipal hearing: the mounting counts as a minor change under Art. 82 para. 3 BauG (BauV Art. 61); the approval must be given in writing after the municipality has been heard. Detail plans and descriptions of the system must accompany the application.
- Release in the notification procedure (Art. 86 para. 2 BauG): the authority normally releases the notifiable project within three weeks if it complies with location, form and the rules. If it proves permit-required, it says so by ruling (para. 1).
- Design rules (Regulation on the Design of Solar Systems, 2024): the Office for Building and Spatial Planning regulates roof-edge setbacks, alignment with ridge, eaves and verge, and glare and reflection. A notifiable system must observe these requirements.
- The Swiss "exempt" rule does not apply here: in Switzerland sufficiently adapted roof systems in building and agricultural zones are permit-free (only subject to notification) under RPG Art. 18a. Liechtenstein does not have this exemption — here the notification duty of the BauG remains.
🔓 Exceptions
- Protection and townscape zones: in protection, core and townscape zones and near registered cultural assets the system can become permit-required. Notification then does not suffice, and townscape or heritage protection can restrict or prevent the design.
- Not every solar system is a roof system: free-standing systems in the garden, on the façade or on the ground can be assessed more strictly than the classic on-roof array — up to a full building permit, depending on size, location and effect on the surroundings.
- Balcony and mini solar systems: plug-in small systems raise additional electrical questions — the grid connection runs via Liechtensteinische Kraftwerke (LKW). We do not state the exact building and electrical threshold here, because it could not be cleanly sourced.
⚠️ Penalties & fines
Anyone who mounts the system without notification risks the restoration of the lawful state (Art. 94 BauG) — up to the removal of the fully installed modules. Unlawful building is a contravention (Art. 99); we do not state the exact fine here, because it could not be sourced from a primary source. In a protection or townscape zone the authority can require even a technically flawless system to be removed. Not obvious: an un-notified system can jeopardize subsidies and the feed-in tariff, complicate the building insurance after a loss, and burden a sale. If the system dazzles the neighbour, they can sue for adjustment or an injunction under Art. 67 SR (excessive effects).

❓ Frequently asked
Does my roof photovoltaic array need a permit?
It is notifiable under Art. 73 lit. h BauG, so not permit-free, but also not always fully permit-required. Before installation you must notify the project to the building authority together with detail plans.
What is the difference between notification and permit?
The notification is a leaner procedure that the authority normally releases within three weeks. A full building permit is more involved and becomes necessary, for example when the system lies in a protection or townscape zone.
Does the Swiss "exempt" solar rule apply here?
No, the exemption under RPG Art. 18a is Swiss law and does not apply in the Principality. In Liechtenstein the notification duty of the Building Act remains, regardless of how well the system is adapted.
I live in a townscape zone — may I still build solar?
It is possible, but there the notification can turn into a full building permit. Townscape and heritage protection can restrict the system, and in the worst case the planned design is not capable of approval.
What happens if I mount it without notifying?
The authority must order restoration, which can extend to removing the modules (Art. 94 BauG). In addition a contravention under Art. 99 threatens, as well as problems with subsidies and insurance.
