Can my boss keep my tips?
No. Tips belong to the employee who receives them — not the employer. The boss may not keep them, not offset them against the wage, and not replace the agreed wage with them. Voluntary tips that guests or customers give additionally and without a legal claim are tax-free for employees (§ 3(51) EStG) and contribution-free — whether in cash or passed on to you by card. A workplace-customary shared distribution ('tronc') among employees is allowed if fairly organised.
📋 The rules
- Tips belong to the employee, not the employer
- The boss may not keep them or offset them against the wage
- Voluntary tips are tax-free for employees (§ 3(51) EStG)
- Also contribution-free — cash or card
- A fair shared distribution (tronc) in the team is possible
🔓 Exceptions
- An employer-imposed 'service charge' is wage, not tax-free tip
- Very high payments to partners/owners can be treated differently for tax
- Tips don't replace the minimum wage — that's still owed on top
⚠️ Penalties & fines
If the employer unlawfully keeps your tips or offsets them against the wage, you can demand payment — if needed before the labour court. Since tips are tax-free, you needn't declare them in your tax return. If they're withheld, the works council or union can help too. Important: tips are an extra — the full minimum wage is owed regardless.
