Am I allowed to drive on summer tyres in winter?
In wintry conditions, no. Germany has a situational winter-tyre rule (§2(3a)): there is no fixed date, but in black ice, snow, slush or frost you may only drive on suitable tyres. The familiar "O-to-O" rule (October to Easter) is just a rule of thumb. Since 1 October 2026, only tyres with the alpine symbol (snowflake, 3PMSF) count as winter tyres — the old M+S marking alone is no longer enough. Breach: from €60 and 1 point.
📋 The rules
- In ice, snow or slush, drive only on winter tyres (situational rule)
- No fixed date — the weather decides, not the calendar
- Since 1 Oct 2026 only tyres with the alpine symbol (3PMSF) count; plain M+S no longer
- Winter tyres must be fitted on all four wheels
- Legal minimum tread 1.6 mm — recommended ≥4 mm on winter tyres
- All-season tyres are allowed if they carry the alpine symbol
🔓 Exceptions
- On dry, snow- and ice-free roads you may drive on summer tyres even in winter
- All-season/all-weather tyres with the alpine symbol meet the rule
- Certain vehicles (e.g. some commercial vehicles) have special arrangements
⚠️ Penalties & fines
Driving in slippery conditions without suitable tyres: €60 and 1 point. With obstruction €80, endangerment €100, a crash €120 — each plus a point. The keeper who allows the trip can also be fined €75 and a point. After a crash on the wrong tyres the comprehensive insurer may reduce its payout.

❓ Frequently asked
Is there a fixed date for winter tyres?
No. Germany has a situational rule: ice, snow and slush decide, not the calendar. "O to O" (October to Easter) is only a practical rule of thumb.
Can I drive on summer tyres in winter?
Only if the road is dry and free of snow and ice. As soon as wintry conditions occur, summer tyres are banned — even for a short trip.
Which tyres count as winter tyres in 2026?
Since 1 October 2026, only tyres with the alpine symbol (snowflake in a mountain, 3PMSF). Tyres carrying only the old M+S marking no longer count.
What does driving without winter tyres in ice cost?
€60 and a point; with obstruction €80, endangerment €100, a crash €120. The keeper who allows the trip can also be fined €75 and a point.
Are all-season tyres enough?
Yes, if they carry the alpine symbol. Then all-weather/all-season tyres meet the rule. Without the symbol they don't count as winter tyres.
