Can I put in a garden pool?
Usually yes — a small, uncovered pool can in many cases go in without a planning permit, but the rules differ by region. In Flanders a pool is exempt if all uncovered constructions in your side and rear garden combined (pool, terrace, pond, paving) stay under 80 m², the whole thing stays below 1.5 m high, sits at least 1 m from the boundary and within 30 m of the permitted house — never in the front garden or a flood-prone area. A covered pool, or one over 80 m², does need a permit. In Wallonia a sunken pool up to 75 m² is exempt at 3 m from the boundaries; in Brussels only an uncovered pool up to 20 m² at 2 m. Note: a pool counts as hard surface for the compulsory rainwater rules, and your municipal regulation may be stricter.
📋 The rules
- Flanders: exempt if all uncovered constructions in the side/rear garden stay ≤ 80 m² combined
- A Flemish pool must be < 1.5 m high, ≥ 1 m from the boundary and within 30 m of the house
- A covered pool, or one over 80 m²: always a planning permit
- Wallonia: a sunken pool ≤ 75 m², ≥ 3 m from boundaries and not in a high-flood-risk zone
- Brussels: an uncovered pool ≤ 20 m², ≥ 2 m from neighbours
- Never in the front garden; the municipal rules can impose stricter conditions
🔓 Exceptions
- Above-ground or inflatable pool taken down in winter: separately exempt in Wallonia, counted in the 80 m² in Flanders
- Larger or covered pools: a permit (in Wallonia often a 'limited-impact permit', no architect needed)
⚠️ Penalties & fines
A pool without the required permit is a planning offence: the municipality can order works to stop and demand restoration (demolition or a value-payment). In Flanders administrative fines can run up to €400,000 for infringements. In practice you mostly risk an order to regularise or demolish — so ask for a planning certificate or check with the planning department before you dig.

❓ Frequently asked
Do the 80 m² cover only the pool?
No — in Flanders all uncovered constructions in your side and rear garden count together: pool, terrace, path, pond. Their total may not exceed 80 m² to stay exempt.
Do I need a permit for an above-ground pool?
A temporary above-ground pool taken down in winter is separately exempt in Wallonia; in Flanders it counts toward the 80 m² and the 1.5 m height. Stay under those and you need no permit.
Can my pool sit against the garden wall?
In Flanders it must be at least 1 m from the boundary, unless against an existing party wall. In Wallonia it is 3 m, in Brussels 2 m from neighbours.
Do I have to notify the municipality?
Even a permit-exempt pool can fall under a municipal or provincial regulation, and it counts as hard surface for the rainwater rules. Always check the local regulation before you dig.
