Can I help a vulnerable relative with a support administrator?
Yes: it's the most flexible protection measure for vulnerable people. The support administrator (amministratore di sostegno) (introduced by Law 6/2004) is a protection measure for those who, due to an infirmity, a physical or mental impairment or even just age, can't, wholly or partly, manage their own interests (managing accounts, signing acts, caring for their health). The Guardianship Judge appoints one by decree, precisely indicating the acts the administrator can perform in the person's name and those for which their assistance is needed. It's less invasive than interdiction and incapacitation: the beneficiary keeps capacity for all acts not expressly entrusted to the administrator. It's requested with an application to the court, which family members (or the person concerned) can also file.
📋 The rules
- Protection measure for those who can't manage their interests
- For infirmity, impairment or even just age
- Appointed by the Guardianship Judge by decree
- More flexible than interdiction and incapacitation
- The beneficiary keeps capacity for non-delegated acts
🔓 Exceptions
- Interdiction/incapacitation: more incisive measures, for the most serious cases
- The application can be filed by family members, the person or social services
- The administrator accounts to the judge and acts in the person's interest
⚠️ Penalties & fines
The support administrator acts in the interest of the beneficiary and under the control of the Guardianship Judge, to whom they must periodically account for the management. Acts performed beyond the powers granted, or in a conflict of interest, can be annulled, and the administrator answers for damages and, in serious cases, for crimes against the person (e.g. misappropriating the estate). To request the appointment, you file an application to the court of the residence, describing the situation and the needs; the judge hears the person and issues the decree. It's wise to get assistance and gather the medical and financial documentation.

❓ Frequently asked
What is the support administrator?
It's a protection measure for people who, due to illness, impairment or even just age, can't manage their own interests. The Guardianship Judge appoints one by a decree indicating the acts they can perform and those for which they assist the person.
How does it differ from interdiction?
It's much less invasive. With support administration the beneficiary keeps the capacity to act for all acts not expressly entrusted to the administrator. Interdiction and incapacitation, instead, limit capacity more broadly and are reserved for the most serious cases.
Who can request the appointment?
The person concerned, family members (spouse, civil partner, cohabitants, relatives within a certain degree), the guardian or curator if already appointed, and also social services or the public prosecutor. The application is filed with the court of the residence.
What can the support administrator do?
Only the acts indicated in the judge's decree: managing the account, collecting the pension, paying expenses, signing certain acts, caring for health, per the person's needs. For acts not provided, the person stays capable. The administrator acts in the beneficiary's interest.
Must the administrator account for their actions?
Yes. The support administrator acts under the Guardianship Judge's control and must periodically account for the management. If they perform acts beyond the granted powers or in a conflict of interest, these can be annulled, and the administrator answers for the damage caused.
