No "right to a socket": you need a vote of the assembly
Updated July 2026

🔌 Can I install an EV charger in my condominium?

With conditions
Quick answer

Yes, but not the way it works in France. The newcomers' myth: believing it is enough to notify the managing agent to install your charger, like the French "right to a socket". In Luxembourg, that automatic individual right does not exist. Under the law of 16 May 1975 on co-ownership, charging-infrastructure works in the common areas require a decision of the general assembly, taken by an absolute majority of the co-owners. If the assembly refuses, all is not lost: the co-owner can apply to the district court, which may authorise the improvement works, provided they do not harm the building's soundness or appearance and do not disturb the others. Installation also opens a state subsidy (Klimabonus): up to €1,400 for a charger meeting the required standard invoiced before the end of 2026, available to tenants too with the owner's written consent.

📋 The rules

  • Charger works in the common areas are decided by the general assembly, by absolute majority (law of 16 May 1975).
  • There is no individual "right to a socket" in Luxembourg dispensing with the assembly vote.
  • On a refusal, a co-owner can be authorised by the district court to carry out the improvement works.
  • The court checks that the works harm neither the soundness, nor the appearance, nor the other co-owners' enjoyment.
  • A Klimabonus subsidy exists: up to €1,400 (EN ISO 15118-20 standard, invoice before end 2026) or €1,200 for a smart OCPP charger.

🔓 Exceptions

  • From 1 January 2027, the Klimabonus subsidy for a compliant charger will be capped at €750.
  • A tenant can apply for the subsidy and the installation, but with the owner's written consent.
  • In a detached house (not co-owned), no assembly is involved: installation is for the owner alone, subject to electrical rules.

⚠️ Penalties & fines

Fitting a charger in the common areas without an assembly decision or court authorisation means doing works without right on someone else's property. The co-owners' association can demand restoration at your expense, even removal of the installation, and hold you liable for any damage to the building or the shared networks. The real cost is also technical and insurance-related: a charger wired to an unsuitable supply can overload the installation, create a fire risk and complicate any claim after an incident. Going through the assembly instead protects your works and, where a court authorises them, sets the terms of use by the others. Skipping the procedure also forfeits the Klimabonus subsidy, which is conditional on a proper, invoiced installation. Finally, an abusive refusal by the assembly is not without recourse: the court can lift it, but that means bringing a case, hence time and cost.

❓ Frequently asked

Can I install my charger without the condominium's agreement?

No, in Luxembourg works on the common areas require a decision of the general assembly, taken by absolute majority. The individual French-style "right to a socket", where notifying the agent is enough, does not apply here.

The condominium refuses — do I have a remedy?

Yes, you can apply to the district court, which may authorise you to carry out the works despite the refusal. The court checks that they harm neither the soundness, the appearance, nor the other co-owners' enjoyment.

Is there any help to fund the charger?

Yes, the Klimabonus scheme offers up to €1,400 for a charger meeting the required standard invoiced before the end of 2026, or €1,200 for a smart OCPP charger. The application is made online via MyGuichet.lu.

Am I concerned if I am a tenant?

Yes, a tenant can apply for the installation and the subsidy, but needs the owner's written consent. In a condominium, the installation still depends on the decision of the general assembly.

Will the amount of the subsidy change?

Yes, from 1 January 2027 the subsidy for a compliant charger will be capped at €750, down from up to €1,400. It can therefore be worth having the invoice issued before that date to benefit from the higher amount.
