Can I get married in Luxembourg, and on what conditions?
Yes, if you meet the conditions — and the first surprise is that only the civil marriage has legal force. Both spouses must be 18; a minor may marry only with the authorisation of the guardianship judge. Since 1 January 2015 (law of 4 July 2014), marriage is open to same-sex couples as well as opposite-sex couples, with identical rights. At least one of the two must officially reside in Luxembourg, the marriage file must be lodged with the register office of the commune at least a month ahead, and the commune then posts the banns for 10 days. The wedding is celebrated at the town hall by the registrar. The myth: "a religious wedding is enough" — false: in Luxembourg the civil marriage is compulsory and must take place before any religious ceremony, otherwise the union simply does not exist in law.
📋 The rules
- Age 18: both spouses must be adults; a minor's marriage requires the authorisation of the guardianship judge.
- Marriage for all: since 1 January 2015 marriage has been open to same-sex couples on equal terms.
- Residence: at least one of the two spouses must officially reside in the commune where the marriage is celebrated.
- Publication of banns: the commune posts the notice for 10 days before the date; the file is lodged at least a month ahead.
- Civil marriage first: only the marriage before the registrar has legal value, and it must precede any religious rite.
🔓 Exceptions
- Authorised minor: a minor may exceptionally marry with the agreement of the guardianship judge, asked to rule on serious grounds.
- Foreign national: anyone not domiciled in Luxembourg must provide a certificate of matrimonial capacity and proof of single status.
- Marriage abroad: a marriage validly celebrated abroad is recognised, but must be transcribed into the Luxembourg civil register to take effect.
⚠️ Penalties & fines
Here the sanction is not a fine but the nullity or blocking of the union. A marriage celebrated where the substantive conditions are not met — bigamy, lack of free consent, a prohibited family tie, an unauthorised minor — can be annulled by the court at the request of the spouses, the family or the public prosecutor, with heavy effects on the matrimonial regime and filiation. A registrar with serious doubts about a marriage of convenience (a sham marriage) may suspend the ceremony and refer the matter to the State prosecutor, who has a set period to object; a marriage staged solely to obtain a residence permit is also a criminal offence. In practical terms, an incomplete file or one lodged too late pushes back the date, and settling for a religious rite without a civil marriage leaves the couple with none of the inheritance, tax and social rights attached to marriage.

❓ Frequently asked
Can I marry a person of the same sex in Luxembourg?
Yes, marriage has been open to same-sex couples since 1 January 2015, with exactly the same rights and duties as for opposite-sex couples. The law of 4 July 2014 aligned the two situations, including for adoption and inheritance between spouses.
Does a religious wedding have legal value?
No, only the civil marriage celebrated by the registrar produces legal effects in Luxembourg. A religious ceremony is allowed, but it must take place after the civil marriage, failing which the union is not recognised by the law.
How far ahead should I prepare my marriage?
The marriage file must be lodged with the register office at least one month before the chosen date, and the banns are posted for ten days. In practice you are advised to come to the commune two to three months ahead, to gather every required document in time.
Do I need to live in Luxembourg to marry there?
At least one of the two spouses must officially reside in the commune where the marriage will be celebrated. A foreign national not domiciled in the country must also produce a certificate of matrimonial capacity and proof of single status issued by their home country.
Can a minor get married in Luxembourg?
In principle no, because both spouses must have turned 18 since the 2014 reform. A minor may marry only exceptionally, with the authorisation of the guardianship judge asked to rule on serious grounds, which remains very rare in practice.
