May I download films and series from torrents?
No. Downloading and sharing protected films, series, music, games and software infringes the Copyright and Related Rights Act (NN 111/2021). A torrent is special here because the client downloads and shares at the same time (seeding) to other users - and that is exactly making the work available to the public, that is, distribution, which is the core of the infringement. The most serious form is a criminal offence: the Criminal Code (Article 285) provides that anyone who, without authorisation, reproduces, distributes or communicates to the public a work belonging to someone else and thereby gains a benefit or causes damage may be punished with up to three years in prison. On top of that, the rights holder can claim damages. The myth that downloading just for yourself is harmless is only half true: the moment you start seeding, you are sharing. In practice, prosecution mainly targets those who upload and distribute, because operators may not monitor traffic without a court order.
📋 The rules
- Unauthorised reproduction, distribution and making available to the public of a work belonging to another infringes the Copyright and Related Rights Act (NN 111/2021).
- A torrent by its nature downloads and shares at the same time (seeding), so downloading inevitably includes distribution.
- Criminal Code (Article 285): unauthorised use of a work for gain is punishable by up to three years in prison.
- The rights holder can bring a civil claim and seek damages, destruction of copies and an injunction against further use.
- The private copying levy built into the price of media and devices covers a copy from a lawful source, and does not legitimise downloading from an obviously unlawful one.
🔓 Exceptions
- Private copying from a lawful source - for example a copy of content you have bought - is allowed for personal use.
- Content under a free or open licence (Creative Commons, public domain) may be downloaded and shared freely under the terms of the licence.
- Watching content on legal services and free content the rights holder offers itself is not an infringement.
⚠️ Penalties & fines
For the most serious cases there is a criminal prosecution: unauthorised use of a copyrighted work for gain is punishable under the Criminal Code by up to three years in prison, the items used to commit the offence are seized, and the unlawful copies are destroyed. Independently of the criminal case, the rights holder can bring a civil claim and seek damages and court costs. In practice, prosecution of individuals in Croatia is rare because internet operators may not check the content a user downloads without a court order and a police request, so prosecution is aimed at those who upload and share on a large scale. The fine figures of 5,000 to 50,000 kuna circulating online come from an older law; what applies is the Copyright Act of 2021 and the Criminal Code.

❓ Frequently asked
Is downloading a film from a torrent punishable?
Yes, because a torrent client downloads and shares the content at the same time, which makes the work available to the public, that is, distribution. Unauthorised distribution of a copyrighted work infringes the law and, when done for gain, is a criminal offence carrying up to three years in prison.
Can I be fined just for downloading and not sharing?
With a torrent, sharing is almost unavoidable because parts of the file are sent to others already during the download. Pure downloading from a lawful source for private use is allowed, but downloading from an obviously unlawful source and seeding are not.
Does my internet operator track what I download?
Operators in Croatia have no power to check the content a user downloads because they have no access to the content of the traffic. That is possible only on the basis of a court order and a police request, so in practice those who upload content are the ones prosecuted.
May I download content under a Creative Commons licence?
Yes, content under a free or open licence, as well as works in the public domain, may be downloaded and shared freely in line with the terms of the licence. The key is that the rights holder has expressly allowed such use.
How big is the fine for piracy?
For the criminal offence of unauthorised use of a work for gain the penalty is up to three years in prison, along with seizure of equipment and destruction of copies. The amounts of 5,000 to 50,000 kuna mentioned online come from an older law and are not a reliable guide.
