Can you marry without witnesses?
You can — and it is a change many people still do not know about. Since 1 July 2024, witnesses are no longer compulsory. A couple may invite none, one or two adult witnesses — and their absence is not an obstacle to the marriage. But both parties must attend in person: neither a witness nor an authorised representative can stand in for a spouse. Age: the ordinary minimum is 18; a person aged 16 or 17 may marry an adult with parental consent. Timing: the marriage is normally concluded no earlier than one month and no later than six months after the application is filed.
📋 The rules
- Witnesses are not compulsory since 1 July 2024
- You may invite none, one or two
- Both parties must attend in person
- Age: normally 18, with consent 16
- Timing: 1–6 months after the application
🔓 Exceptions
- In an urgent case the registry official may shorten the one-month waiting period
- The age exception applies only from 16, with consent, and only where the other party is an adult
- A foreign national must also evidence marital status, and checks may take up to six months
⚠️ Penalties & fines
There is, of course, no fine for marrying without witnesses. But there are obstacles the official may not ignore. The registry official must refuse to conduct the ceremony where a legal obstacle is known — for instance, one party is already married, the parties fall within prohibited close-family relationships, or the age conditions are not met. And the consequence is severe: a marriage concluded in breach of certain fundamental conditions may later be declared legally non-existent. Old sources mislead: many municipal and ceremony pages still say two witnesses are compulsory — that was the previous rule and no longer applies.

❓ Frequently asked
Are witnesses compulsory?
They are not. Since 1 July 2024 a couple may invite none, one or two adult witnesses, and their absence is no obstacle to the marriage going ahead.
Can someone stand in for me?
No. Both parties must be present in person. Neither a witness nor an authorised representative can replace a spouse — that is one of the fundamental conditions of marriage.
What is the minimum age?
The ordinary minimum is 18. A person aged 16 or 17 may marry an adult where a parent or guardian consents. If consent is unreasonably refused, the Orphan's Court may give it.
How long is the wait?
The marriage is normally concluded no earlier than one month and no later than six months after the application and required documents are filed. In an urgent case the month can be shortened.
Why do other sources say two witnesses?
That was the previous rule. Many municipal and ceremony pages still repeat it, but since 1 July 2024 witnesses have not been compulsory at all.
