Who is liable if a dog bites someone?
The owner — and it is not only a question of money. The Animal Protection Law provides that one of the dog owner's duties is to ensure the animal does not disturb or endanger people or other animals. Outside a fenced area a dog must be kept on a lead; off the lead it may only be in green areas and forests, under the owner's supervision and in sight, at a distance at which the owner can control its behaviour. Where that duty is breached and the victim suffers light or moderate bodily injury, the owner faces short-term imprisonment, community service or a fine. Where the consequences are serious bodily harm or death — imprisonment of up to three years.
📋 The rules
- The owner must ensure the dog endangers nobody
- Outside a fenced area — on a lead
- Off the lead — only in green areas and forests
- And only in sight and under control
- For bodily injury — the owner answers
🔓 Exceptions
- For light or moderate harm: a fine, community service or short-term imprisonment
- For serious bodily harm or death: imprisonment of up to three years
- Damages can be claimed separately in civil proceedings
⚠️ Penalties & fines
The consequences come in two forms — and both can arrive together. The criminal side: for breaching the rules on keeping animals, where the victim suffers light or moderate bodily injury, the owner faces short-term imprisonment, community service or a fine; where serious bodily harm or death follows — imprisonment of up to three years. The civil side: the victim can claim damages separately — medical costs, lost earnings, torn clothing. And one more important point: where an attacking animal threatens a person or their property and no other means of defence is available, someone who injures or kills that animal owes its owner no compensation. Record everything: the doctor's certificate, photographs, witnesses.
