How is a marriage dissolved and can I divorce by agreement?
Conditional — you can divorce, but only through the court; in Albania there is no divorce at a notary or civil-status office. The myth is that “by agreement you can split quickly at a notary” as in some countries. No: under the Family Code (Law no. 9062/2003), every dissolution of marriage needs a court decision. There are three routes: by mutual consent (Articles 125–128), when both agree and present an agreement on children and property; by breakdown of cohabitation when the spouses have lived factually apart for 3 years; or by one spouse's request on grounds such as violence, infidelity or continuous quarrels. Even when you agree on everything, the file goes to the court, which decides on custody, child support and division of property. Until the decision becomes final, you cannot remarry.

That is why a clear agreement from the start, approved by the court, is often the cheapest and fastest route to a resolution.
