Can I be paid less than the minimum wage in Luxembourg?
No — the minimum social wage rules are a matter of public policy. Since 1 June 2026 (index 992.24), the SSM stands at €2,771.33 gross per month for an unskilled employee aged 18 or over, and €3,325.59 for a skilled one. The costliest myth: "I signed for €2,400, I accepted it, I can't claim anything." Wrong — a pay clause below the minimum is void by operation of law, and the back pay is owed retroactively. Second myth: that the skilled rate requires a diploma. Also wrong: 10 years of practice (or 6 in a technical trade) qualify you with no certificate at all. Posted workers are entitled to the SSM too — it is public policy. Only under-18s may lawfully be paid less, at 75-80% of the rate.
📋 The rules
- Unskilled SSM (18 and over): €2,771.33 per month gross, i.e. €16.0192 per hour (100%), in force since 1 June 2026 at index 992.24 — legal base €279.30 at index 100 (art. L.222-9 of the Labour Code).
- Skilled SSM: 120% of the base rate, i.e. €3,325.59 per month (€19.2231/h). Qualification comes from a diploma (CATP/DAP) but also from experience: CCP/CCM plus 2 years, CITP plus 5 years, 10 years of practice with no certificate, or 6 years in a technical trade.
- Adolescents: aged 17-18 = 80% = €2,217.06 per month; aged 15-17 = 75% = €2,078.49 per month.
- Apprentices fall outside the SSM: their training allowance is set by grand-ducal regulation and is far lower (for example €672.40 a month in the first year of a CCP florist assistant).
- Automatic indexation: +2.5% as soon as the consumer price index rises 2.5% over the half-year. Recent history: €2,637.79 on 01.01.2025, €2,703.74 on 01.05.2025, €2,771.33 on 01.06.2026.
🔓 Exceptions
- Apprentices and trainees in initial training are outside the scope of the SSM: their allowance follows a separate, markedly lower scale.
- Employees under 18 are subject to a statutory reduction of 20 to 25%: paying €2,078.49 to a 16-year-old is perfectly lawful.
- Posted workers in Luxembourg are entitled to the SSM, which is public policy — but indexation applies only to the minimum wage itself, not to pay above it.
⚠️ Penalties & fines
A criminal fine plus full back pay with statutory interest. The cost nobody anticipates lies elsewhere: the CCSS reassessment. Because contributions were calculated on an insufficient base, the employer must regularise them — and the employee discovers that their pension rights were built on years of under-declared career. On top comes the ITM administrative fine of €25 to €25,000 (art. L.614-13) where a written injunction from the director is ignored. The "€251 to €25,000" figure circulating on HR sites is not confirmed by any official source: do not rely on it.
