📈 My phone or internet price is going up: can I leave my contract in Switzerland?

The short answer

Telecom law gives no specific right to leave after a price rise; your contract decides. Ombudsman practice: the agreed price cannot be raised during a fixed minimum term, vague change clauses require an exit right, and changes should be announced at least 30 days ahead.

When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Switzerland.

📜 The rules in Switzerland

Price rises built into the contract

Some terms allow a yearly inflation-linked rise per service without an exit right. The ombudsman sees that exclusion as problematic and possibly unfair under Art. 8 UWG when the total burden is high, for example with several services from one provider.

The details

  • A price rise must be announced clearly, with the amount. In a published case the provider named a new fee without stating its amount, so the ombudsman found the old price still applied. (cas.ombudscom.ch)
  • For the universal service, the Federal Council sets maximum prices, and the licence holder must report any tariff change to BAKOM at least 30 days before it applies (Art. 22 FDV). (fedlex.data.admin.ch)

❓ Questions

Is a price rise linked to inflation allowed?

It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Switzerland on this page.

How much warning must the provider give?

Providers usually have to tell you before the change starts. Where the rules in Switzerland set a notice period, it is on this page.

What if I miss the deadline to leave?

The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
