Yes — a home game for money among friends is legal. The Gambling Act regulates operating gambling, not private play: as long as you play privately, the circle is closed and — the key — nobody profits from organising (no rake, no host entry fee, no table charge), there's no "operation" at all. Players may win; the house may not. The line where illegal gambling operation begins: regular public tournaments, advertising, a cut of the pot, "club" fees — that draws heavy fines (and at scale the crime of unauthorised game operation). Pub poker without a licence is therefore the operator's problem. Winnings from private games aren't taxed (occasional wins between individuals).
