Can I post someone's photo online in Czechia?
Not without consent — and note you may need it twice. Publishing a photo interferes with the personality rights of the person shown (their likeness, § 84–85) and with the photographer's copyright if the shot isn't yours. "It's from his Instagram" is not a licence — re-uploading someone's photo without permission breaches both. Narrow exceptions: news reporting (public-interest events, proportionate), art/caricature with limits. The hardest lines: intimate images — distributing them without consent is a crime; with children you're in criminal territory practically always. Even an "innocent" party photo of a friend can end in a lawsuit — asking first costs nothing.
📋 The rules
- Publishing a likeness: the depicted person's consent (§ 85)
- Someone else's shot: additionally the author's licence
- Re-posting from their profile is not consent
- Narrow exceptions: news, art, science — proportionate always
- Intimate images and children: criminal exposure — never without consent
🔓 Exceptions
- Your own photos with implied consent of those shown (group shots shared among participants)
- Public figures in public roles: news contexts
⚠️ Penalties & fines
Personality lawsuits: takedown, apology, non-material damages (courts award tens of thousands CZK). Copyright: damages and unjust enrichment. Non-consensual intimate images: criminal (stricter for minors).

❓ Frequently asked
May I share a group photo from a party?
Among participants yes (implied consent by posing); a public tagged post requires that nobody reasonably objects — delete on request.
He posted the photo himself. May I re-post?
His publication isn't your licence — platform-native sharing yes, downloading and re-uploading without permission no.
What about photos of my own children?
Parents decide for small children — but mind their future privacy; never post other people's children without parental consent.
Someone posted my photo. What can I do?
Demand removal, report to the platform (rights violation), sue for personality protection; with intimate images go straight to police.
