📈 My phone or internet price is going up: can I leave my contract in Ireland?

The short answer

Your provider must notify you of any contract change on a durable medium at least one month ahead. Unless the change only benefits you, is purely administrative with no negative effect, or is imposed by law, you can leave without further cost before it takes effect.

When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Ireland.

📜 The rules in Ireland

Price rises built into the contract

An increase written into your contract when you signed (CPI-linked, a fixed percentage or a set amount, usually each April) does not give you a penalty-free exit during the minimum term.

The details

  • Many contracts have a built-in yearly increase (CPI, a fixed percentage, both, or a set monthly amount), usually in April. With a built-in increase you generally cannot leave without a penalty during your minimum term. (comreg.ie)
  • If your contract has no built-in increase, or you are past your minimum term, you can switch without penalty when your price goes up. (comreg.ie)
  • You can end the contract free of charge from the notice until the day before the change, limited to the last four months before it takes effect. (irishstatutebook.ie)
  • ComReg Compare shows which phone and broadband plans have no built-in annual price increases, and the details of the increases where they apply. (comreg.ie)

❓ Questions

Is a price rise linked to inflation allowed?

It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Ireland on this page.

How much warning must the provider give?

Providers usually have to tell you before the change starts. Where the rules in Ireland set a notice period, it is on this page.

What if I miss the deadline to leave?

The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
