What age can I buy alcohol or tobacco in Austria?
It depends on the product — 16 for beer/wine, 18 for spirits and all tobacco. Tobacco, e-cigarettes, water pipes, e-shishas and nicotine pouches are banned under 18 — nationwide since the 2019 harmonisation. Alcohol under 16 is banned in all provinces. From 16 to 18, non-distilled drinks (beer, wine) are allowed, but spirits and alcopops are banned until 18. It's an offence to supply these products to younger people — including via vending machines. The rules of the province where the young person is apply; ID may be required. In short: beer/wine from 16, spirits and tobacco from 18.
📋 The rules
- Tobacco, e-cigarette, nicotine: only from 18 (nationwide)
- Alcohol under 16: banned in all provinces
- 16–18: beer/wine yes, spirits no
- Alcopops/spirits: only from 18
- Supplying to younger people is an offence
🔓 Exceptions
- Some provinces: a BAC cap even for permitted drinks
- Powdered alcohol/concentrates are also banned
- Tobacco-free nicotine pouches expressly banned under 18
⚠️ Penalties & fines
Both the young person and the supplying adult or retailer can be fined under the relevant province's youth-protection law (in some provinces by an on-the-spot penalty). The tobacco sales ban to under-18s has applied nationwide since 1 January 2019. Beware a myth: "at 16 you can buy any alcohol, and you can smoke at 16" is false — from 16 to 18 only beer and wine are allowed (no spirits), and tobacco, e-cigarettes and nicotine are 18+ everywhere in Austria. Tip: retailers check age, so keep ID ready.

❓ Frequently asked
What age can I buy tobacco?
Tobacco, e-cigarettes, water pipes, e-shishas and nicotine pouches may only be acquired, possessed and consumed from age 18. This age limit has applied nationwide in all provinces since 1 January 2019. Supplying to younger people is an offence, including via vending machines.
What age can I buy alcohol?
Under 16, the acquisition, possession and consumption of alcohol is banned in all provinces. From 16 to 18, non-distilled drinks such as beer and wine are allowed, while distilled alcohol, spirits and alcopops are only allowed from age 18.
Can I buy spirits at 16?
No. From 16 to 18 only non-distilled alcoholic drinks such as beer and wine are allowed. Distilled alcohol, spirits and spirit-based mixed drinks like alcopops are only permitted from age 18 in all provinces.
Is buying alcohol for younger people an offence?
Yes. It's an offence to supply or pass on these products to young people who haven't yet reached the relevant age. Both the supplying person and the retailer, and the young person themselves, can be fined under the province's youth-protection law.
Do the rules apply the same everywhere?
In essence yes, since the tobacco limit of 18 and the alcohol stages of 16 and 18 apply nationwide. But what matters is the rules of the province where the young person currently is. Some provinces add, for example, a BAC cap even for the permitted drinks.
