Is your job protected during parental leave in Estonia?
It is — and the statute says so plainly. A mother or father is entitled to parental leave until the child turns three. Taking parental leave does not affect the parent's right to return to work or the retention of their job — you do not “lose your place” because you stayed home with a child. During the leave the parent is entitled to parental benefit and childcare allowance under the Family Benefits Act. And parental leave is open to both parents — consecutively or alternating, which gives families a real choice about who stays home, and when.
📋 The rules
- Available until the child turns three
- Open to mother and father
- The job is retained
- The right to return does not lapse
- Benefits apply during the leave
🔓 Exceptions
- Both parents may use parental leave, consecutively or alternating
- Parental benefit and childcare allowance are payable during the leave
- You may return early by notifying the employer
⚠️ Penalties & fines
Job retention is statutory protection, not employer goodwill. Taking parental leave does not affect the right to return to work — and if an employer tries to dismiss you during the leave or immediately after it, that is a serious red flag and can be taken to the labour dispute committee, which is free. The second thing worth knowing: you can return early by notifying the employer — you are not locked in for three years. And the third, financial: parental leave itself is not a benefit — the money comes from parental benefit and childcare allowance, applied for at the Social Insurance Board, and those are separate applications. File both.

❓ Frequently asked
How long can parental leave last?
A mother or father may take parental leave until the child turns three. Both parents may use it, either consecutively or alternating between them.
Is the job protected?
It is. Taking parental leave does not affect the parent's right to return to work or the retention of their job. This is statutory protection, not employer goodwill.
Can I return early?
You can. It is possible to return before the end of the leave by notifying the employer, so you are not tied down for three years if circumstances change.
Where does the money come from?
From parental benefit and childcare allowance, paid under the Family Benefits Act and applied for at the Social Insurance Board. These are separate from the leave itself.
What if the employer threatens dismissal?
Take it to the labour dispute committee, where applying is free. Dismissal because of parental leave is a serious breach and can be challenged.
