Does a home-made will last forever in Estonia?
It does not — and that surprises almost everyone. A home-made will lapses once six months have passed since it was made, if the testator is still alive at that point. A notarial will, by contrast, is valid indefinitely. The home-made will has another trap: if it does not state the day and year it was made, and this cannot be established otherwise, the will is void. There are two permitted forms: a handwritten will, or one signed in the presence of witnesses — and the latter needs at least two capable witnesses present at the same time. And one cunning detail: if a home-made will altered a notarial one and then lapsed, the notarial will becomes valid again.
📋 The rules
- Home-made will: valid 6 months
- Notarial will: indefinite
- Without a date, a home-made will is void
- At least 2 witnesses are needed
- They must be present at the same time
🔓 Exceptions
- A home-made will may be handwritten or signed before witnesses
- Witnesses must be capable adults of at least 18 years
- If the home-made will lapses, an earlier notarial will revives
⚠️ Penalties & fines
Six months is shorter than a life. A home-made will made more than six months ago by someone still alive no longer has effect — and the heirs discover this only after the death, when nothing can be fixed. If your wishes are settled, make a notarial will: it is valid indefinitely, it is held in the register, and it cannot be lost or “accidentally” thrown away. Home-made wills fail in three classic ways: a missing date (the will is void), one witness instead of two, and the six months running out. And remember the reviving notarial will: if a home-made will changed it and then lapsed, the old notarial will takes effect again.

❓ Frequently asked
How long does a home-made will last?
A home-made will lapses once six months have passed since it was made, if the testator is still alive at that time. A notarial will, by contrast, remains valid indefinitely.
What if the date is missing?
If a home-made will does not state the day and year it was made, and this cannot be established otherwise, the will is void. It is the classic failure of home-made wills.
How many witnesses are needed?
A will signed before witnesses must be signed by the testator in the simultaneous presence of at least two capable witnesses aged at least 18 years.
Does a notarial will expire?
It does not. A notarial will is valid indefinitely, is kept in the register and cannot be lost. If your wishes are settled, it is the safest form available.
Can an old notarial will revive?
Yes. If the testator altered or revoked a notarial will by a home-made one and the home-made will has since lapsed, the earlier notarial will becomes valid again.
