My phone or internet price is going up: can I leave my contract in Austria?
Your provider must send you changes to prices or terms that are not solely in your favour at least three months in advance, on a durable medium. Until they take effect you may cancel free of charge (§ 135(8) TKG 2021).
When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Austria.
📜 The rules in Austria
Price rises built into the contract
Rises under an objective index clause (usually linked to the consumer price index) are allowed and give no right to cancel, provided the clause was agreed in your original contract.
The details
- Purely administrative changes, or changes the law makes directly necessary, do not give you this free cancellation right (§ 135(9) TKG 2021). (ris.bka.gv.at)
- Price rises under an objective index clause are allowed and give no right to cancel, but only if the clause was already agreed in your original contract. It is usually tied to the consumer price index. (rtr.at)
- If you cancel early for such a change, the provider may only charge an early-termination payment if you keep a device it supplied (§ 135(12) TKG 2021). (ris.bka.gv.at)

❓ Questions
Is a price rise linked to inflation allowed?
It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Austria on this page.
How much warning must the provider give?
Providers usually have to tell you before the change starts. Where the rules in Austria set a notice period, it is on this page.
What if I miss the deadline to leave?
The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
