The penalties fall on the seller first, not the smoker. Shops are fined for selling tobacco or nicotine to anyone under 18, and they are fined for stocking products with a banned flavour or the wrong packaging — from 1 April 2026 that includes nicotine pouches in any flavour other than tobacco or menthol, and pouches over 9.0 mg nicotine. Institutions and workplaces are fined for breaching the smoke-free environment rules, and schools are responsible for smoke-free school time. For the individual smoker, the usual consequence is being asked to step outside.
