When can I make noise (DIY, music) in Belgium?
Some life is allowed — excessive nuisance isn't, and at night noise becomes an offence. The law works in three layers. Night noise (racket disturbing the peace, roughly between 22:00 and 7:00) is criminally punishable — police may show up, kill the music and write it up. By day the local police regulation rules: noise nuisance is the classic GAS offence (up to €350), and mowers and machines are often banned on Sundays and holidays. Above it floats the civil anchor: article 3.101 of the Civil Code — neighbours owe each other normal tolerance, but whoever crosses into the excessive (serial night parties, a dog barking all day, permanent bass) can be ordered by the justice of the peace to compensate or take measures, even without fault. Practical ladder against racket: talk first, then the neighbourhood officer or municipal mediation, then conciliation at the justice of the peace — and for acute night noise, simply the police.
📋 The rules
- Night noise (±22:00–7:00): punishable — police can intervene and fine
- Daytime: police regulations — GAS fines up to €350
- Art. 3.101 Civil Code: excessive nuisance → compensation/measures, even without fault
- Machines/mowing: often banned on Sundays and holidays (check your municipality)
- Ladder: talk → neighbourhood officer/mediation → justice of the peace
🔓 Exceptions
- Normal living sounds (children playing, footsteps, an occasional announced party) must be tolerated between neighbours
- Licensed events and hospitality venues with sound permits: own norms and hours
⚠️ Penalties & fines
Night noise: criminal fines and possible seizure of the sound system; by day GAS up to €350. Civil route: the justice of the peace can impose penalty payments, insulation works or damages for excessive nuisance.

❓ Frequently asked
Until what time can I play music?
There's no legal 'party hour': night noise disturbing the peace is punishable once it disturbs (classically from 22:00) — warning the neighbours helps a lot but grants no immunity.
The neighbours' dog barks all day. GAS or court?
Both tracks exist: report to the neighbourhood officer/municipality (GAS) and, if it persists, the justice of the peace — measures and penalty payments via art. 3.101.
Can I mow the lawn on Sunday?
In many municipalities no — police regulations often ban noisy machines on Sundays and holidays; check your local regulation.
What about a night party next door?
Call the police (101 for acute nuisance): night noise is punishable and the patrol can stop the music; log dates for a possible file.
