🌿 Can I grow and keep cannabis at home in Czechia?

With conditions
Quick answer

Yes — since 1 January 2026 home growing is legal in Czechia, but only within strict limits. Anyone 21 or older may grow up to 3 cannabis plants (including THC above 1 %) and possess up to 100 g of dried cannabis at home and 25 g outside the home. The limits count per person, not per household. You may grow only in property you own or rent, and the plants must not be visible from public spaces — an open balcony facing the street does not qualify. The common mistake: 4–5 plants is a misdemeanour and 6 or more a criminal offence starting at one year, and giving or selling any amount to another person remains a crime — even a few grams handed to a friend for free. Zero tolerance for THC still applies behind the wheel.

📋 The rules

  • Age 21+: maximum 3 plants per person
  • Possession: 100 g dried at home, 25 g outside
  • Only in property you own or rent, not visible from public spaces
  • No transfer or sale — distribution stays criminal at any amount
  • Zero tolerance for THC when driving still applies

🔓 Exceptions

  • 4–5 plants: misdemeanour (fine); 6+ plants: criminal offence (up to 18 years for organised forms)
  • Industrial hemp under 1 % THC has its own, looser regime
  • Medical cannabis on prescription works independently of these limits

⚠️ Penalties & fines

Up to 3 plants, nothing happens. 4–5 plants or slightly exceeding the gram limits is a misdemeanour: a fine plus administrative proceedings whose costs land on you. From 6 plants the case turns criminal — sentences start at 1 year and reach 18 years for organised forms, plus a criminal record that complicates employment for years. Selling and giving cannabis away are criminal at any quantity, and it is the person who handed it over who is prosecuted. Driving after use is punished separately: zero THC tolerance means a fine, a ban and possible prosecution.

❓ Frequently asked

Can I buy cannabis seeds?

Yes. Selling seeds was legal even before — only growing was criminal. Since 1 January 2026 growing is legal too, but only up to 3 plants, from age 21, and in property you own or rent.

Can I keep plants on my balcony?

Only if they are not visible from public spaces — visible plants are explicitly prohibited. An open balcony facing the street is not enough; you need a screen or a spot invisible from the pavement.

Can I share a few grams with a friend?

No. Any transfer to another person remains a criminal offence regardless of quantity, and that includes handing over a few grams for free. Only growing and possession for your own use within the limits are legal.

Is the 100 g limit per person or per household?

Per person aged 21+, and the limits are assessed individually. Two adults sharing a home do not pool them — each has their own allowance of 3 plants, 100 g dried at home and 25 g outside the home.

Can I drive after using cannabis?

No. Traffic law keeps zero tolerance for THC no matter that growing is now legal — expect a fine, a driving ban and possible prosecution. The legal origin of the cannabis is no defence at a roadside check.
