How tall can my fence be in Czechia?
Up to 2 metres permit-free — taller only via the building office. The new Building Act classes fencing up to 2 m that doesn't border publicly accessible land (the street) and stands wholly on your plot as a small structure: no permit, no neighbour consent. Street-facing or taller fences need the office's assessment (and municipal plans may regulate looks — transparency, base walls). The neighbourly classics: there is no general duty to fence (courts/offices order it only exceptionally), a fence exactly on the boundary is maintained jointly, and hedges may grow skyward until their shade and leaves exceed locally reasonable levels (Civil Code § 1013).
📋 The rules
- Up to 2 m, not bordering public space: no permit
- Above 2 m or street-facing: building office (plus municipal regulations)
- Whole fence on your own land; on the boundary only by agreement
- Maintenance: each keeps their side; boundary fences jointly
- No statutory duty to fence — imposed only exceptionally
🔓 Exceptions
- Heritage zones and protected landscapes: their own fence-appearance rules
- Hedges: no height cap, but § 1013 (nuisance) and trimming rights apply
⚠️ Penalties & fines
Over-limit fences without approval: illegal structures — retroactive permits or removal, administrative fines. Shade and overhang disputes: neighbour lawsuits.

❓ Frequently asked
Do I need the neighbour's consent for a 2 m fence?
No — built wholly on your land and away from public space, it needs neither consent nor a permit.
Who pays for a shared fence?
Whoever wants a new fence pays; one exactly on the boundary is joint and maintained half-half — hence build slightly inside your land.
Can I force the neighbour to fence?
No general duty exists; courts/offices impose it only exceptionally (e.g. animals). Build your own on your side.
The neighbour's hedge shades my garden. Limits?
No height cap — the defence is § 1013 (excessive shade) and the right to trim overhangs after a request.
