🏠 Can I rent out a property short-term without registration?

With conditions
Quick answer

Increasingly no: short-term hotel-regime rental needs registration and a unique code. From 20 May 2026, Romania's and the EU's short-term rental market comes under EU Regulation 2024/1028. Each home promoted online (Airbnb, Booking etc.) for short-term rental must have a unique SITUR code, shown in all listings. "Hotel regime" means uninterrupted rental to the same person for at most 30 days a year, per room or accommodation space. To keep renting lawfully you need: a valid classification certificate, registration in the SITUR platform and obtaining the code, a special VAT code for platform commissions, enrolment in RO e-Invoice, and completing the occupancy records (ANAF). Note: as of June 2026 the SITUR technical platform was not yet operational, a transition period being under way.

📋 The rules

  • From 20 May 2026: EU Regulation 2024/1028 applies
  • Each unit online: a unique SITUR code in listings
  • Hotel regime = max 30 days/year to the same person
  • Needed: classification certificate, SITUR registration, RO e-Invoice
  • Duty: occupancy records (ANAF)

🔓 Exceptions

  • Transition period: the SITUR platform still not operational in June 2026
  • Long-term (residential) rental: not under these rules
  • Implementation details: still being clarified by the authorities

⚠️ Penalties & fines

Without a SITUR code and without meeting the duties, listings can be removed by the platforms, which must verify the code, and owners risk sanctions and tax problems. Besides registration, you must declare and tax the accommodation income, keep the occupancy record and observe guest safety rules. Since the SITUR platform wasn't fully working in mid-2026, follow official announcements and prepare the documentation (classification certificate, unit data) to get the code once the system goes live. During the transition, already sort out your classification certificate, RO e-Invoice enrolment and income records.

❓ Frequently asked

Must I register a property I rent out short-term?

Yes, gradually. From 20 May 2026 EU Regulation 2024/1028 applies, requiring each unit promoted online for short-term rental to have a unique SITUR code. In June 2026 the technical platform wasn't yet operational, but the duties will become effective in the coming period.

What does hotel regime mean?

Hotel-regime rental means uninterrupted accommodation of the same person for at most 30 days in a calendar year, per room or accommodation space. This definition distinguishes it from long-term residential rental, which follows other rules and duties.

What is the SITUR code?

It's the unique identification code each hotel-regime accommodation unit must obtain and show in online listings. Platforms like Airbnb and Booking must verify this code, and without it offers can't be published.

What duties do I have as an owner?

You need a valid classification certificate, registration in the SITUR platform with the code obtained, a special VAT code for platform commissions, enrolment in RO e-Invoice, and completing the occupancy records. You must also declare and tax the accommodation income.

Do I have to pay tax on hotel-regime accommodation?

Yes. Regardless of the registration duty, hotel-regime rental income is declared and taxed at ANAF. There may also be VAT duties on platform commissions and the completing of occupancy records. It's advisable to consult an accountant for the details.
