🛠️ Can I claim a product's warranty?

With conditions
Quick answer

Yes, for 3 years on goods. Since 1 January 2022, the legal warranty on any good you buy is 3 years from delivery (it used to be 2), and 2 years for digital content and services. If the product has a lack of conformity (defect), you can demand free repair or replacement within a reasonable time and, if unresolved, a price reduction or a refund. In the first 2 years the defect is presumed to have existed at purchase (the seller must prove otherwise); after that, you must prove it. The warranty is owed by the seller and is free.

📋 The rules

  • Legal warranty of 3 years on goods (since 01/01/2022)
  • 2 years for digital content and services
  • Right to free repair or replacement
  • First 2 years: defect presumed from origin
  • The seller is liable; the warranty is free

🔓 Exceptions

  • Damage from misuse or normal wear: not covered
  • Second-hand goods: the period can be agreed, minimum one year
  • The commercial (maker's) warranty is additional and voluntary

⚠️ Penalties & fines

A seller who refuses to apply the legal warranty, or tries to charge for it, breaches consumer rules and can be sanctioned by Consumer authorities. If unresolved, you can claim at the OMIC or your region's Consumer office, and go to consumer arbitration or court. The repair or replacement must be free (no shipping or labour) and within a reasonable time (around 30 days).

❓ Frequently asked

How long does a product's warranty last?

3 years from delivery for goods (since 1 January 2022), and 2 years for digital content and services. During that period you can claim if the product has a defect or lack of conformity.

Is the warranty free?

Yes. Repairing or replacing the defective product must be free, with no shipping or labour costs, and done within a reasonable time (around 30 days). Charging for the legal warranty is contrary to consumer rules.

Who has to prove the defect?

In the first 2 years the defect is presumed to have existed at delivery, so the seller must prove otherwise. From the third year, you must prove the lack of conformity already existed when you bought it.

What can I demand if the product fails?

First, free repair or replacement, at your choice (unless disproportionate cost). If not resolved in a reasonable time, you can ask for a price reduction or a refund.

What if the shop won't respond?

File a written claim and, if unresolved, go to the OMIC or your region's Consumer office, to consumer arbitration or, ultimately, court. Keep the receipt or invoice as proof of purchase.
