📈 Can my landlord raise my rent?

With conditions
Quick answer

Yes, but only in specific cases. During a lease, the landlord can only raise the rent if there's an annual revision clause indexed to the IRL (rent reference index published by INSEE): the rise is then capped at this index's change, once a year. At re-letting or renewal, the landlord's freedom depends on the zone: in towns applying rent control (Paris, Lille, Lyon, Bordeaux, Montpellier…), rent is capped by a reference rent. Finally, rents of energy sieves (F and G) are frozen: no revision or increase is possible until the home is renovated.

📋 The rules

  • During a lease: rise only with an IRL revision clause
  • Revision once a year, capped at the IRL change
  • Rent-control zone: rent capped
  • F and G sieves: rents frozen (no revision)
  • Increase for improvement works: framed and negotiated

🔓 Exceptions

  • Manifestly under-valued rent: re-assessment possible at renewal (framed procedure)
  • Major improvement works: increase possible under conditions
  • Outside tight/control zones: rent freer at re-letting

⚠️ Penalties & fines

A rent increase during a lease without a revision clause, or beyond the IRL, is invalid: the tenant can contest it and claim a refund of the overpayment. In a control zone, a rent over the cap can be brought down to the allowed level, with restitution. Revising a sieve's (F/G) rent is banned. In a dispute, the departmental conciliation commission then the judge can be involved.

❓ Frequently asked

Can my rent rise every year?

Only if there's an annual revision clause indexed to the IRL. The rise is then capped at this index's change and can only happen once a year. Without a revision clause, the rent stays fixed during the lease.

What's rent control?

In some tight-market towns (Paris, Lille, Lyon, Bordeaux, Montpellier, etc.), rent at re-letting or renewal is capped by an increased reference rent. A rent over this cap can be contested and reduced.

Can an energy sieve's rent rise?

No. Rents of homes rated F and G on the EPC are frozen: no annual revision or increase at re-letting until the home is renovated to reach a better energy class.

Can the landlord raise rent after works?

An increase is possible after major improvement works, under framed conditions usually set by a clause or agreement. It must be justified and can't be imposed arbitrarily during the lease.

What to do about an abusive increase?

Contest in writing, recalling the rules (revision clause, IRL, control). You can go free to the departmental conciliation commission, then the judge. The overpayment can be returned to you if the rise is found irregular.
