📝 How many hours can I work on an agreement?

With conditions
Quick answer

It depends which agreement you hold — each has its own ceiling. The Labour Code knows three agreements outside an employment relationship. The agreement to perform work covers a specific task and is capped at 350 hours per calendar year with the same employer. The agreement on work activity covers regular work of a smaller scope: at most 10 hours a week on average. The student work agreement is only for students and is capped at 20 hours a week on average. The contribution break: students and pensioners may claim a deductible item of €200 a month — up to that sum no pension insurance is paid.

📋 The rules

  • Perform work: at most 350 hours a year with one employer
  • Work activity: at most 10 hours a week on average
  • Student work: at most 20 hours a week
  • Students and pensioners: a deductible item of €200
  • Up to €200, no pension insurance is paid

🔓 Exceptions

  • The deductible item can be claimed with only one employer at a time
  • Accident and guarantee insurance is paid even on sums below €200
  • A person on an agreement is still entitled to the minimum wage and to premiums

⚠️ Penalties & fines

An agreement is not "work without rules". Someone working on one is still entitled to the minimum wage and to premiums for night work, public holidays and weekends — and the employer must record their working time. Mind the 350 hours: it is a ceiling per calendar year and per employer, and exceeding it is a breach of the Labour Code by the employer. And mind the deductible item: it can be claimed with only one employer at a time and must be notified in writing — forget that and you lose it, paying contributions on the first €200 as well.

❓ Frequently asked

What agreements exist?

Three: an agreement to perform work, for a specific task; an agreement on work activity, for regular work of a smaller scope; and a student work agreement, open only to secondary and university students in full-time study.

What are the hour ceilings?

The agreement to perform work is capped at 350 hours per calendar year with the same employer. Work activity is capped at an average of 10 hours a week, and student work at an average of 20 hours a week.

What is the €200 deductible item?

A contribution break for students and pensioners: no pension insurance is paid on remuneration up to €200 a month. Above that, contributions are paid only on the excess. It can be claimed with one employer at a time.

Are any contributions paid at all?

Accident and guarantee insurance is always paid, even on sums below €200, because the deductible item does not apply to it. The rest depends on the type of agreement and on whether you claim the break.

Am I entitled to the minimum wage?

Yes. Someone on an agreement is entitled to the minimum wage and to premiums for night work, public holidays and weekends. The employer must also record their working time — an agreement is not work without rules.
