My phone or internet price is going up: can I leave my contract in Malta?
Your provider must notify you of any contract change, such as a price rise, at least 30 days ahead on a durable medium. You may then cancel free within 30 days unless the change only benefits you, is purely administrative or legally required.
When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Malta.
📜 The rules in Malta
Price rises built into the contract
Index-linked rises do not give a general right to leave. That is why the MCA limits contracts with an index clause to a six-month commitment, and gives older, longer contracts an exit right after the first six months.
The details
- You can have the contract ended before the change takes effect, paying only for the service up to that date and for any subsidised equipment you keep. (mca.org.mt)
- Price rises under an index clause, linked to an official consumer price index, are not treated as a contract change. Contracts with such a clause concluded from 8 January 2024 may bind you for six months at most. (mca.org.mt)
- In contracts with an index clause agreed before 8 January 2024 with a commitment over six months, an index-linked rise applied after the first six months lets you cancel without penalty. (mca.org.mt)
- Index-linked rises must be notified to you on a durable medium at least 30 calendar days in advance, with a subject line that clearly says your charges are going up. (mca.org.mt)
Malta Communications Authority (MCA)
Takes your complaint about a phone, internet or TV provider once you have complained to the provider first. It intervenes where a rule it enforces was broken; otherwise it mediates or refers you to the right forum.
🪜 Step by step
- Read the notice carefullyNote the date the change starts and any deadline to react. Keep the message.
- Check your contractSee whether the contract already set out this rise, for example a yearly increase linked to inflation.
- Decide whether to stayCompare offers. If you have the right to leave, use it in writing before the deadline.
- Complain if the rules were not followedIf you were not told properly or the rise breaks your contract, complain to the provider and then to the dispute body.

❓ Questions
Is a price rise linked to inflation allowed?
It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Malta on this page.
How much warning must the provider give?
Providers usually have to tell you before the change starts. Where the rules in Malta set a notice period, it is on this page.
What if I miss the deadline to leave?
The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
