McDonagh: no cap on the right to care
The Icelandic ash-cloud ruling — extraordinary, yet care still owed without limit.
Legal referenceC-12/11, 31 January 2013
When Icelandic volcanic ash grounded flights for days in 2010, an airline argued such "super-extraordinary" events should suspend the right to care. The Court disagreed.
It held there is no temporal or financial limit on Art. 9 care: the airline must keep providing meals and accommodation for as long as the disruption lasts, even when no compensation is due.
