Can I carry pepper spray for self-defence in Hungary?
Yes — but only the 'milder' kind, and discreetly at that. Decree 175/2003 lists gas sprays among devices especially dangerous to public safety, but exempts sprays up to 20 grams of agent that contain no capsaicin (oleoresin) or PAVA — the classic CS-based tear-gas sprays sold in shops fall in this circle. The manner of carrying is prescribed too: in public places the spray may be held only in a case, box, closed container or concealed under clothing — swinging it in hand is already a violation. Where no spray may go at all: organised public events (festivals, demonstrations, stadiums). True pepper spray (OC/capsaicin, PAVA) stays in the banned circle for civilians — that's a law-enforcement tool. Even the legal spray may only be used in legitimate self-defence: repelling an unlawful attack — spraying 'for fun' is assault. Sale to minors is prohibited.
📋 The key rules
- Legal: sprays with max 20 g agent, capsaicin- and PAVA-free
- Carrying: in a case, box or concealed under clothing — not openly in hand
- Events (festivals, protests, stadiums): no sprays at all
- True pepper spray (OC/PAVA): banned for civilians in public
- Use: only in legitimate self-defence
🔓 Exceptions
- At home and on private property possession isn't restricted — the rule targets public carrying
- Dog-repellent sprays: a separate retail category — still unlawful to spray at people outside self-defence
⚠️ Penalties
Publicly possessing banned devices (pepper spray, over 20 g) or carrying the legal spray openly is a misdemeanour: fines and confiscation. Use outside legitimate self-defence is punishable as assault.

❓ Frequently asked questions
Is real pepper spray banned? It's sold abroad.
In Hungary sprays containing capsaicin or PAVA sit in the banned circle for civilians — the legal exception is the max-20-gram spray without those agents (CS type).
Should I carry it in my bag or on my belt?
Enclosed: in a case, box or concealed under clothing — visibly carrying it in hand is a violation, and no spray enters organised events at all.
Can I spray an attacker?
In legitimate self-defence yes — to the extent needed to repel an unlawful attack; without an attack (arguments, intimidation) spraying is assault.
Can my 16-year-old buy one?
No — especially dangerous devices can't be sold to minors; lawful buyers also answer for whom they pass it to.
