Can I wear a mask at a protest in Hungary?
Generally no — Hungarian assembly law demands identifiability. Under the assembly act, participants may not cover their faces, except where the acknowledged notification included it (say, as a performance element). The rule was reinforced by the Constitutional Court's February 2026 decision: participants' identifiability is a legitimate aim, the restriction necessary and proportionate. Practice's shades: medical masks (epidemics, illness) and scarves against the cold used as intended aren't the concealment scenario — police judgment is situational though, and on request the face must be shown. The symbolic mask (Guy Fawkes and friends) is viable when recorded in the notification. Breaching the rule is a misdemeanour — and at dispersals the masked participant argues from the worse position.
📋 The key rules
- Default: at assemblies faces may not be covered
- Exception: where the acknowledged notification included it (performance, costume)
- Constitutional Court, Feb 2026: the restriction is constitutional
- Medical masks/scarves used as intended: not concealment — but show your face on request
- Violation: a misdemeanour
🔓 Exceptions
- In epidemic situations medical masks are naturally judged differently
- Religious dress: a separate weighing circle respected in practice
- Where the acknowledged notification included the masked element (performance, costume), wearing it is lawful
⚠️ Penalties
Unlawfully covering your face is a misdemeanour: it ends in a fine, and at an ID check the mask alone invites police attention. Refuse the officer's request to show your face and the case slides towards disobedience against police measures — which can end in being taken in. In violent incidents the mask weighs as an aggravating factor: deliberately defeating identifiability worsens your standing before the court. And the practical handicap: at a dispersal the masked participant argues from the weaker position, with less benefit of the doubt.

❓ Frequently asked questions
Are medical masks banned at protests too?
A mask used as intended, for health reasons, isn't the concealment scenario and isn't unlawful in itself. In a dispute, though, police may ask you to show your face — and you must comply.
What about masked costume performances?
Where the assembly's notification included the masked element and was acknowledged, wearing it is lawful. The clean route is agreeing it with the organiser before the notification goes in.
What did the Constitutional Court say?
In February 2026 it confirmed that participants' identifiability is a legitimate aim and the face-covering ban a necessary, proportionate restriction. The rule stands; the arguments against it ran out.
Can police photograph me at the protest?
Recordings of participants may be made in securing the event — that's the other side of the identifiability principle. In exchange you may film the policing; our police-filming page covers it.
Can a winter scarf or hat get me in trouble?
A scarf worn against the cold, used as intended, isn't concealment and isn't banned. Police judgment is situational though: on request you must make your face visible, and the dispute ends there.
