My phone or internet price is going up: can I leave my contract in Poland?
A provider may change your contract terms, including the price, only in cases the Pke allows. In a fixed-term contract, a change caused by outside circumstances it could not foresee lets you cancel without compensation until the change takes effect (art. 307 Pke).
When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Poland.
📜 The rules in Poland
Price rises built into the contract
The Pke has no separate rule on inflation or index clauses. In 2022 UOKiK, the consumer protection authority, examined such clauses in fixed-term telecom contracts as possibly abusive and said they must protect both sides and the price must be clear at signing.
The details
- Such a change is possible only if your contract provides for it. The provider must send you each proposed change on a durable medium and publish it on its website at least one month ahead, telling you of your right to cancel. (eli.gov.pl)
- Changes required directly by law, such as a VAT change, or by a UKE decision: you may still cancel until they take effect, but the provider can then claim early-exit compensation. An SMS with only a download link does not count as delivery. (eli.gov.pl)
- Indefinite or automatically renewed contracts: changes are allowed only if your contract sets out the circumstances in which they may happen, and you can cancel until they take effect. (eli.gov.pl)
- If you cancel after an unforeseeable change and keep your promotional device, the provider may claim only the lower of the remaining service fees or the remaining device fees, spread over at least as many instalments as billing periods left. (eli.gov.pl)
UKE – wniosek o interwencję
Ask UKE to intervene if a provider fails to carry out, or wrongly carries out, a switch, number porting or number change, or may have broken the Pke. Send the request by post, e-Doręczenia, ePUAP or the PUE UKE form.

❓ Questions
Is a price rise linked to inflation allowed?
It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Poland on this page.
How much warning must the provider give?
Providers usually have to tell you before the change starts. Where the rules in Poland set a notice period, it is on this page.
What if I miss the deadline to leave?
The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
