My phone or internet price is going up: can I leave my contract in Italy?
Your provider must tell you about any change to your contract at least 30 days in advance. If you don't accept it, you can leave or switch without penalty or deactivation costs within 60 days of the notice.
When a provider changes the price or terms during your contract, you may have the right to leave without a fee. That depends on what your contract already said about price changes and on the rules in Italy.
📜 The rules in Italy
Price rises built into the contract
An inflation-indexation clause applies only if you accepted it explicitly in writing. Increases under it do not give you a penalty-free exit, and they cannot start in the first 12 months of the contract.
The details
- There is no free exit when the change is only to your advantage, purely administrative with no negative effect, or imposed directly by EU or national law. (normattiva.it)
- If you leave within 30 days of the notice, the old conditions apply until your line is closed and the provider must refund any excess charged. (agcom.it)
- The notice must come on a durable medium headed 'COMUNICAZIONE IMPORTANTE: MODIFICA DELLE CONDIZIONI DEL CONTRATTO' or similar; mobile customers also get an SMS. (agcom.it)
- With an accepted indexation clause the index is ISTAT's FOI index without tobacco, decreases must be passed on too, and if an increase exceeds 5% of the fee you can move free of charge to a similar offer without indexation. (agcom.it)
Autorità per le Garanzie nelle Comunicazioni (AGCOM)
Telecom regulator. Its contact center answers questions and takes reports: 800.185060 from a landline, 081.750750 from a mobile or abroad, Monday to Friday 10:00-14:00.

❓ Questions
Is a price rise linked to inflation allowed?
It can be, if the contract set it out clearly. Whether it gives you a right to leave is in the rules for Italy on this page.
How much warning must the provider give?
Providers usually have to tell you before the change starts. Where the rules in Italy set a notice period, it is on this page.
What if I miss the deadline to leave?
The new price then usually applies. You can still leave at the end of the minimum term, or with notice if the contract already runs on.
